The FAA has filed its appeal brief in the Pirker (Huerta v. Pirker, Docket No. CP-217) matter. Further proof that it does not understand its own regulations, substantively or procedurally. It might as well have filed a blank piece of paper. It’s truly amazing that the FAA is banking on this piece of silliness to prevail on appeal. Either they lack attorneys who understand the law, or their goal to lose, again.
